This would normally go unnoticed but for the fact that every bank is now writing to claimants informing them of this decision. This decision was made by a district judge in a county court which does not make this judgement binding on any other similar case. The banks know this, but they are trying to put off potential claimants by sending out misleading letters informing them of this judgement. This shows that the banks are running scared. Sure the odd case will be found in favour of the banks. That's life, perhaps the claimant did not put forward a good enough case we don't know. But what we do know is that in many cases the banks just don't turn up. In a recent Five Live radio interview, a successful claimant experienced this very fact. After the judge made his judgement in favour of the claimant, he then spoke candidly, stating that he had yet to see a bank turn up and defend an action. Always ask the bank for a full explanation of any decision it takes with regard to your situation and any legislation involved. Remember that banks want to make money from your money, do not make it easy for them. |
