Joined: 09 May 2007 Posts: 5 | hey all, Not sure if this is the right place to post this but... Recently I changed banks as my wife and I were getting a joint bank account. After I had transferred all my debt, standing orders and direct debits across I left £100 in the bank just in case something I had forgotten about had to come out. Anyway it turns out, surprise, surprise a cheque I had written 4 months ago gets cashed and put me into an un-authorised over draft. So 10 days letter I get a fine for £30 for going into this. I phoned them up and let them know that I understood why I got charged, "yes I do know its in the terms" yadda yadda, but I told them I didn't agree with the cost, and because of that I now wanted to cancel my current account. To which they did no questions asked really, although I had to move money to pay the fine. Now this is where it gets annoying... A week later I see my savings account with them, with no money in it might I add, had gone into the red as well. This is because as well as the £30 charge for going into my unauthorised overdraft, I got another £28 charge for bouncing a cheque, so they moved that into my savings and put it into the red for which they wanted to charge me for as well. This is a joke right, I phoned them again, and once again I had to remind them, I know fine well why I have been charged, as they insisted on telling me, but firstly I don't agree with the values charged and secondly the other charges were caused by them not thinking. Is there anyway to contest this, as I seemed to be getting no where with the branch. Thanks cmp |

Joined: 01 May 2007 Posts: 401 My Profile | Hi cmp You're right it is a joke!! Good news. The banks have been found out! They can't just charge punitive penalties should you overdraw etc. on your account. What you need to do is write a letter to your bank, instructing them that they are in breach of contract and you want all charges refunded to you. If they don't refund the charges then you can sue them in the Small Claims court. The Small Claims procedure is relatively informal and inexpensive and you get your day in court. Think I will try and keep it simple though, often have a habit of being really sarcastic when im annoyed at things like this. Should be worth it though as thats nearly £100 for nothing. The same amount the bank was advertising they would pay you if you moved to them four months back. |

After reading threads regarding Bank Charges i decided to pursue, now, which is 2 months later i get a response from my bank with my total charges. and the following information. "Lloysds TSB has now become involved in legal proceedings with the OFT in relation to unauthorised charges. We believe these proceeding will resolve the legal issues regarding the fairness and legality of these charges. Where we recieve complaints about these bank charges we would usually try to resolve them through our internal complaints as quicky as possible. However, until the determination of the legal issues in the above proceedings, we have asked the FSA to suspend the normal timetable for dealing with bank charges complaints which relate to unathorised overdraft charges The FSA has agreed to this request subject to conditions that protect your rights. What will happen next will depend on the courts. We do not know how long the case will take - we have promised to proceed as quickly as possible but inevitably given the importance and complexity of the issues being considered this may take many months to finally resolve. However, if you decide to make a complaint, we can assure you that the details of it will be registered - and once the legal proceedings with OFT are concluded, we will resolve your complaint asap. If at that stage you do not agree with our resonse you will be able to refer your case to the FOS or to the courts. the FOS has decided to put all invesigations on hold until a decision has been made by the courts." Well, What does this mean to me?? Am i too late?? what do i do next?? Should i respond now or wait? i really do not know. Please help George or anyone else who knows exactly whats going on. Joined: 06 Jun 2007 Posts: 225 My Profile | Hi Daz, I am not that well versed in all of the issues surrounding claiming of unfair bank charges, but I do know this that the internal complaint system based on advcie from the OFT does not prevent you from bringing your case against the bank in the Small Claims court. The letter which you have copied just seems like a bit of prevarication on the part of the bank, trying to mislead to you into thinking there is only one way to deal with your complaint, there isn't, take them to court. P |
