Joined: 12 Nov 2009 Posts: 1 | Hi All, first post here & im hoping i can get some advice. I took out a credit card when i was around 18 (now 31), and i used up the limit which was around £600 in a few days as i was going on holiday. In the begining i made regular payments, for around the first 12 months. Then i stopped paying when i moved away to work. i had a few letters sent to my previous address but then they stopped. I remember that my surname was mis-spelt by one letter, my surname is potter, name on card was porter. The card was with yorkshire bank. A few months ago i got a letter from 1st credit finance demanding £132.00 from me for going overdrawn on my yorkshire BANK ACCOUNT in around 1998, which was seperate to the credit card but spelt correct. This account is no longer open and i am paying a weekly amount to pay off the debt. They have obviously got me on revcord as the same person with which the credit card debt belongs. So my question is, can i get out of paying the debt with the name being mis-spelt? sorry for the long winded post. Thanks in advance for any advice given |

Joined: 06 Jun 2007 Posts: 240 My Profile | hi dfw An interesting situation in respect of the misspelling of your name. I am not really sure about this but, my spider senses are tingling. Your debt appears to be time barred in any case which means there is nothing formal the debt collectors can do about the debts. You may well be in a position to re-claim back all your money you've paid on the card as the paperwork will reflect that your credit card agreement, which is regulated by the Consumer Credit Act, was improperly executed. The mere fact that they have got the wrong name on the card and I imagine the agreement should make this relatively easy. P |
