Joined: 07 Sep 2007 Posts: 13 My Profile | ok ,it starts off like this. i am a merchant mariner in the united states for 10 yrs. due to my job i'm not home much and my wife pays the bills. I have recently found out that creditors are constantly calling the house and also found out that my bank acct was frozen due to an unpaid bill from at&t a service that we never had. Well we had it for a few days and had it cancelled due to a party line and we couldn't make any calls without some else being on the line at the same time. So we cancelled it and got verizon. The lawyer says that we owe 891.us dollars from nov. 2001. I also found out that she has 2 credit card acct's in collection 1 of which she said was paid off years ago. we are a few months behind on a bunch of other payments. How do i prove that i don't owe at&t any money and how do i prove that she paid off that 1 credit card when i don't have the documentation? What can i do to make payment agreements with these other companys that i'm having a hard time paying?any help you may have will be greatly appreciated. thanks, |

You seem to have either a problem which may be browser related or we have not properly explained how to fill the SOA or it may be just you ;). Can you let me know what browser you are using eg Internet Explorer, FireFox etc. |

Joined: 07 Sep 2007 Posts: 13 My Profile | thanks george it very well could be me but idon't no for sure. heck i couldn't even get to the second page to see my reply, thats why i wound up sending it twice. i am using aol (it's actually compuserve but it is the same as aol) and internet explorer. i just went down today to get my at&t judgement reopened. stating that i was never served and never having the debt. i have to back in the morning to see what happened.if the judge would reopen it or not. wish me luck! thanks, e-zersaid |

Joined: 07 Sep 2007 Posts: 13 My Profile | sorry george i just tried it from my home pc and it worked.i will get to the s.o.a within the next day or two.back to the collections people i sent $200. to my sears c /c acct. collection company.they want $289.00 for the next 4 monthsand i really can't afford that. i can do 200. per month but thats it.i told them that and they said no good. any suggestions? e-zersaid |

From that you'll be able to see where you can make savings/sacrifices. You may well find that you are able to afford the extra $89! Bankruptcy means the creditor can realise certain assets, cars and property etc and also some of your income on a regular basis. However, they can only take from you income what's left after reasonable living expenses have been accounted for. (You can't be left destitute.) This is where your SOA is useful as it demonstrates, both to yourself and the creditor, that you are taking steps to pay off your debt. The SOA basically proves your claim of "this is all I can afford" which may make the creditor more agreeable to a lower payment.
