hi please can some one help. i have a creditor looking for me for a dept from 1993/94. i have no idea what the dept is for. please can some one advise on what to say when he comes to my home. thanks gorak

Unfortunately a charging order has a limitation of 12 years, so you can't avoid paying this debt off.

can someone help, i did a credit check and found i owed 5000 to cahoot.from 2005 not sure if i did or i didn`t but haven`t heard anything. shall i contact them or just keep quiet and hope for the 6 year rule!

I have had one of these, chase ups from a company and it is going back to 2003. I have not heard anything from them until now and they said if I did not make payment they would start court action.

I made a interim payment to hold this off.

Will I now have to pay the full amount off as I have acknowledged the debt. or can I get my money back that I paid because of the Statues of Limitations

Hi I have a debt from 2005 which I haven't paid any money off of since march 2008. They seem to have my wrong address shall I leave it. Can they find me if they don't have my correct address?

can anyone tell me what my rights are..... I moved to my new area in 2002 and now a debt collecter says i owe £417 on a credit card from when i lived in my old home... i don't remember having one but they say that i did..... i am unemployed i don't have a spare fiver at the moment, let alone this so called debt! what are the laws on credit cards?

I received a CCJ about ten years ago for missing payments and falling behind to the Student Loan Company. I offered To pay £50 per month and this was accepted and I have paid ever since never missing a payment. The CCJ has now expired off my credit file and I now have good credit. Yesterday I recieved a telephone call from a company saying they had bought the debt and wanted full payment of £1,600 now. I said I could not afford the full amount and why could nt I go continue with the re payment plan I had. They said they would give me a week to get the funds and said I should apply for a loan to pay the amount or borrow from friends. I said I was not prepared to get in debt to pay a debt. They threatened court action and it would double my debt and I would have a CCJ.

I have thread some threads about non enforceable debts when the debt has been acknowledged, however in my situation I have acknowledged the debt since I have been paying for the last approx 8 years.

Is there anything I could do as I dont want to ruin the good credit I now have and they are scaring me or do I need to apply for a loan.

Any advise apprecaited, Thanks

I don't see how they can take you to court for a second time. If the agreed amount, determined by the court, is £50, then the court isn't going to redetermined their own judgement are they?

I agree with paladin, id be surprised if they could take you to court aswell im more inclined to wager its standard bully boy tactics, sad thing is they no doubt bought the debt for 50quid or somethin similar really is,

u could either play the game callin there bluff armed with the knowledge your defence at any kind of court date would be im in a payment arrangement anyway, OR if as you say you have good credit you could try a different approach, some peeps may dissaprove of what im about to say though i would stress its being recommended in a manner SPECIFICALLY meant to cause u the least hardship or minimum extra cost

if you have a high enough credit limit on a credit card pay it off with that in full then take out a new one for what we call STOOZING purposes,

so then do a balance transfer of the credit card debt you would have just built up to ure new card MANY deals are currently available including 0% interest for your balance for 15months EFFECTIVELY ure credit card/debt collection payment would become an interest free debt giving u 15months to clear it before any new potential debt would occur, thats what i do theres typically a small handling fee with this approach however in the grand scheme of things its mostly negligible then once debts been paid close the card down before your tempted to run up any more

oh before i forget IF u use this approach you may find urself taking out a few credit cards provided u do this in a RESPONSIBLE manner its a SAFE approach it can look bad though if you apply for more than 1 credit card at the same time, hoever ud AVOID it looking bad by playing the credit reference agency game avoid cards like rbs etc who check experian and equifax instead id take out one with mbna who only search EXPERIAN and one with SYGMA who only search EQUIFAX plus sygmas new creation card has one of those 0% for 15 month deals etc

Until they are paid back plus interest. Why would they let it go. If they did it for you, then what's to keep everyone else from not paying.

Does the limitation act apply if you have moved addresses? Say you inccured the debt over six year ago but the creditor were not able to locate you because you moved

as the law stands and i checked this today, if a creditor cannot and has not had any contact what so ever from the debtor for a period of 6 years including telephone calls and mail then from 6 years onwards the debt is can no longer be chased through the legal system (courts). in other words, they cannot claim the debt back off you unless you want to give it to them.

Just to add to the above, it doesn't matter where you stayed during the last 6 years, whether you were abroad or in prison.
