I have just had a company called CRS send me a text message saying they are sending someone round in the next 48hrs so I rang the number to be told it is something to do with some car insurance that I appriatly took out in 2006! Well I don't remember doing this and I have never recieved any documents regarding this and I asked where they were sending all the letters to and they say an address that I moved out of over 3 years ago! Can someone give me advise on what I should do as I have just applied to rent a new flat and am now worried it is going to affect this and I also want to buy a house next year and also worried this is going to affect my chances!!! I haven't given them my new address and they only have my mobile number! Help!! x |

After finishing my education I moved out from the country and now i recieve a letter from the council tax dept that i need to pay my council tax. How does one pay tax when he is not staying on the mentioned property? And also i came to know that some bank has given my name to CIFAS for first party fraud. Unfortunately, i did not close my bank account before moving back due to an emergency. I wish to come back to UK, but i am in a fix. Please advise me how to clear things out and come clean. |

I recently received another letter from them saying that their client (?) had confirmed that their information was correct and that they were still pursuing me for the alledged debt. My wife opened the letter and despite my protestations that I don't owe a penny took it as gospel. I immediately rang HBOS with whom the loan account they quoted was with and spoke to someone in their legal dept. He confirmed that the account was closed in 2002 and theat the balance at the time was zero. He said that he would get the archive dept to send me relevant copies. He kindly offered to speak to my wife and confirmed the account had been settled and closed over 7 years ago, she now speaks to me again! Today, I was woken up again (I work nights) by Robinson Way ringing on my landline, asking me to confirm my details as usual and I didn't and just said I had spoken to HBOS and hung up. They immediately rang me again on my mobile which I ignores so no doubt there'll be another letter in the post. Once I get confirmation from HBOS can I approach Robinson Way from a different angle and threaten them with legal proceeding for the constant harrassment they have been giving me and the obvious lies they have been using (ie stating that they have contacted HBOS etc which they can't have because they'd have received the same information I have)? Your comments/advice is appreciated. |

Joined: 01 May 2007 Posts: 494 My Profile | Madtyke Next time they are on the phone tell them that you have installed call recording, in fact some mobile phones allow call recording. Keep a diary of when they call you what was said and who you speak to. You could also contact Nuisance Calls Bureau (OFCOM) and speak to them about this matter. Also speak to your local trading standards department who enforce the Consumer Credit Licences. The information that you provide may help build as case against the company. If through a simple call to HBOS your account can be checked then Robinson were negligent in not doing a simple check. You should also speak to the police regarding harassment as this is a criminal matter. I have posted a couple of links below which you may find helpful. I have had 2 letters within the last few weeks,1 from Telogram ltd,and the other from H L Legal,they are chasing me and threatening to come to my house.I have no idea what the debt supposedly is,but they had found me from i property i owned around 15 years ago ! I have no intention of replying and certainly wont admit to a debt that i know nothing about. Any ideas from anyone on here on how to proceed ? Tara |

Joined: 08 Oct 2009 Posts: 1 | Hi can you help please the creditor was looking for me for the last 6 years ,i think from 2003??? not quite sure !!! they didn't manage to get me as I left England anyway i manage to open a basic bank account a few weeks ago and then deposited a cheque in it then the bank hold the cheque ?? Don’t know why they said it will go to the fraud team!! i need to know why? is it because of my debt please let me know I can't sleep over this |

I go in over my head and had nowhere to turn so i left the country for 3 and 1/2 year and since i've been back i've had a few phone calls and letters but have never acknowledged the debts. Now my father is sick and has done his will. He wants to leave the house to me but is worried incase the debtors can take it from me. My question is can they take it off me? |

I spoke to the Halifax with whom the loan I settled was with and they confirmed that it had been paid in full in 2002 and they suggetsed I spoke to my local CAB. I went last Monday with my file and they were very impressed with the non-acknowledgement letter I copied from this site. The guy at the CAB also rang Robinson Way & Co Ltd and spoke on my behalf to one of their agents and told him that not only was the loan settled in full but that it was outside the 6 year limit. He advised them that they should discontinue their pursuit and to stop harassing me on the phone. They apparently agreed to do so. Lo and behold, I received a standard letter yesterday saying that they acknowledged my dispute and would seek clarification with their client ? (They advised CAB that they bought the debt ? in Feb 2006) and that the would stop collection for the time being. At the bottom of the letter in BOLD Black type was a message advising me that the account had been transferred from Robinson, Way & Company Ltd to Robinson Way Ltd. Is this just another ploy by Robinson Way to attempt to keep the matter alive? |

Joined: 06 Jun 2007 Posts: 240 My Profile | If you have read this thread I think you know the answer to this one. A twenty year old debt is time barred. It shouldn't even appear on your credit file. Some companies are making a lot of money from credit agreements which were improperly executed - meaning that you could get all the money back you paid. But I don't think you want to rake up old coals do you. Should anyone contact you again either just ignore it or say you have installed call recording and if they call again you'll contact the OFT or Trading Standards. P |

Joined: 05 Dec 2009 Posts: 1 | hi id liek some advice please, in 2006 i owed a company 300 for a phone contract that got cancelled but lost my job at the time and couldnt pay it, i started claiming job seekers allowance and said i could pay them a certain amount each week and they said theyd send me another letter regardin the matter but never heard anything ever again, since then iv moved house 5 times and the other day i got a call from a finance company and they aske dme to confirm my details and liek an idiot i did, they should have confirmed them to me as they rang me, then they informed me theyd send loads of letters to my current address, which is not true i ahvnt recieved anything from them in 3 and half years, so they said theyd send me another letter. i understand about the 6 years gap and what not but a few friends told me even if i offer to pay 5pounds amonth they can refuse and ask for expenditure form, but im a single mum on benefits and might not be able to pay what they ask for. are my friends right in this matter? |

Joined: 10 Dec 2009 Posts: 1 | Hi I have a similar issue, about 7 years ago, a charging order was made against my property, which I didn't contest. It was for £12,000. However Robinson way have been persuing me on and off since to repay the debt, in addition to the charging order. As the debt is over 6 years old, can I write to them to tell them to back off. They started to call me at work about 3 or 4 years ago, however I wrote to them stating if they continued to harrass and embarrass me at work I would report them to the OFT, that seemed to do the trick. However, they continue to write to me, and just recently I've been sent an Attachment of Earnings etc. The Debt is 7 years old, is there anything I can do? Thanks! |
