Joined: 23 Aug 2008 Posts: 1 | Hi, Can anyone help please? I received a letter in the post today from a firm of sherriff officers in edinburgh/lothians. They tell me they have been instructed to carry out an attachment of goods to cover a debt of £435 they say they will come to the house to carry out the attachment then immediately make an application for the uplift of goods to be sold in an auction. They then go on to say that the officer has a warrant authorising him to break open a lockfast door to get in. I am living in a fully furnished house, have been since January, can they take my landlords posessions and sell them. I am at my wits end, I don,t have the money to pay them, please help. |

Only goods which are yours and not essential to living can be attached, so your landlords furniture will be safe. You say you received a letter form sheriff officers, is this the first formal correspondence you have had about your debt ie have you received any court summons, a charge for payment et? Have you received a booklet detailing what the Sheriff Officers can and can't do? Read this article for more information about Exceptional Attachment Orders. The Sheriff Officers can enter your house under a Exceptional Attachment Order but they must give you four days notice when they intend to enter your premises. I think you really need legal advice and you can get this from either your local Money Advice (see local authority) or the Citizen Advice Centre. Since if the creditors have not followed the procedures correctly, you may be able to stop the attachment order proceedings. Post back if you need any more help . Good luck George |
