Joined: 05 Jan 2012 Posts: 1 | I have recieved letters form active capital on debts that are over 6 years old, I sent them an email with the template letter claiming that the debt was statute barred and I recieved a reply stateing that though my last payment was over 6 years ago that the original debtor had placed a default against me so there has never been a six year period and therefore this debt is not statute barred. I thought it took a ccj to avoid barring of the debt. Is this true that the debt is not statute barred or are the debtors just trying to blufff me. My last payment was made in june 2005 and I have never been in touch since to make any acknowledgement of the debt. |
