   Phone Calls From Creditors

Hi,

I've got myself into a fair mess with debts now, and I am looking to get if fixed. Whats really stressing me is Im getting phone calls form debt collection companies at home and more annoyingly at my work.

I've talked to one company and said I was trying to sort things out but Im still getting calls, its really worrying me as its not the thing you want your work to know.

Please help, any info would be really helpful.

There are a few things you can do to stop creditor
harassment. If you live in England you are covered by The Protection from Harassment Act 1997. This makes it a criminal offence for the creditor to harass you. The first thing i would do is write to the creditors which are harassing you and quote the Act and state that by phoning you at work and at home amounts to harassment.

Unfortunately if you live in Scotland you have no such protection. However, the OFT have stated that they consider this type of activity oppressive. This may impact on their capacity to hold a credit licence. If they lose their licence their out of business.

So next time the creditors start pestering you, tell them you are recording the call and you will be reporting them to trading standards.

If anybody has any other tips (legal!!)on how to stop creditors from harassing you then please post.

thanks for that, I'll certainly give it a go. I'm planning to sit down this weekend and get everything sorted, so hopefully i wont need to use it.

Ill be back with more questions though!

Hi,

I think I know how you feel Stressed!

I have recently applied for an IVA due to fincancial difficulties.
One company who i owed money to were Egg PLC, this was due to me being in arrears with my credit card. I had an arrangement with them to pay off the arrears but they then sent this debt off to a collection company.

On contacting this company they stated that they would not settle for monthly payments and wanted the money outright which i had no chance in rasing the money.

I told them what i was doing with regards to the IVA and passed them the details of the company i am dealing with.

I have more recently been receiving letters at my place of work and my supervisors have also had letters addressed to them requesting me to contact them. My employers are allowed to open mail at work and so are now aware of my debt.

I have replied to letters both by phone and by letter, they stated that they havent recieved any reply from me.

I would like to know where i stand with this matter as they have now appliied to the County Court to take action, despite being aware that i am looking into an IVA. They also stated that they would not accept this IVA when it is proposed.

All in all I felt that they were very threatening towards me and would not accept what i was telling them.

I need advice please as this is affecting me personally.

The above thread will help you with respect to the creditors harassing you at work. They may have committed an arrestable offence, speak to the police or your local trading standards department.

In respect of your IVA and Egg speak to your IP. He will have a better idea of what can be done in respect of time-scales.

The courts will normally look more favourably on debts which are being currently addressed. So they may refuse Egg's application.

Feedback about what your IP says would be helpful to the rest of the forum members.

on the opposite end of the scale, i appear to have i debt to cahoot that i found through a credit check, but goes back to 2005, but i have not had a peep out of anybody! should i contact them or sit tight for 1 year to bring the debt to over 6 year???
