Joined: 18 Jan 2010 Posts: 4 | hi, I dont know if i have put this message in the right place but i am new to your site and desperate for some advise. My husband was previously married and they owned a house, (mortgaged) in both his and his ex wifes name. They have been divorced for 12 years and had the house repossessed. The house was sold approximatly 13 years ago and they owed money to the mortgage company. We have never heard anything from them until today, I got a phone call from a company called AU UK asking for my husband, i told them he was at work they asked me to tell him to ring them urgently which he did and found out they were a debt agency looking for £20000 with regards to the mortgage. He confirmed with them his date of birth and address and they said they had posted something out to him. Any ideas on what we can do would be very much appreciated. |

Joined: 01 May 2007 Posts: 492 My Profile | Hi Jolly If the mortgage debt is older than 12 years then it is time barred. This means that they debt collectors cannot pursue the debt through the courts. In fact, unless you decide to pay up the outstanding money then there is precious little the debt company can do about it. Edit: I have just read your post in the another thread (now deleted which states the house was repossessed 11 years ago) . You need to be sure when this was done. |

Joined: 18 Jan 2010 Posts: 4 | Hi DW George, thanks for replying to my question. We are trying to work out the exact dates but having a bit difficulty. We do know it is around 12 years, is there any way we can find this out without starting the ball rolling as to paying this amount. My husbands ex wife seems to think it is 12 come may or june. |

Joined: 18 Jan 2010 Posts: 4 | Hi George, Just to let you know it was 11 years come april since the house was repossessed. i have tried for the past few days to research this on the internet but it is very confusing, I read that in the year 2000 if you had your house repossessed that they must inform you of the shortfall within 6 years or you dont need to pay the debt. My husband is not trying to shun this debt but he is just so annoyed that they have left it for nearly 11 years before contacting him. We are not in the situation to pay this money. Any advise would be very much appreciated. |
