I took out a loan frim HSBC in 2004. Also a mastercard. They included my partner at that time for income and expenditure forms and said that i could afford the loan. I took out payment protection incase of loss of my job etc.
My partner lost his job the following year and even though they had taken into account his earnings in the affordability of the loan, because it was in my name only we could not get any help. This is where my debt started.

I later split with my ex partner and went through a debt management plan which i eventually stopped paying as HSBC would not freeze interest and the amount just kept going up.
After this i moved addresses and have heard nothing from HSBC until now.
I recieved a mastercard statement to my new address saying that I am 50 in credit. They took my mastercard away a long time ago so is this just a ploy to get me to contact them???

How long can they contact me for before the debt is written off? according to my credit report i didn't actually get a default filed from them until 2007.

Any help would be much appreciated x

Hi wondering if someone can help me,i have recently been contacted by the CSA again regarding,arrears on my account. Its a long story but basics are that i have filled out every form they have ever sent me,and i never hearrd form them i then contact them and they just say an assesment hasnt yet been made and they will contact me soon. Always i never get a reply,about 5 years ago they took me to court and i was fond by the court to be liable for all the arrears, i tried the arguement that i had never been contacted by them,and the last contact i had with them was 1 week before we went to court and they said at that time that an assesment had been made on what,they think my incomings and out goings were. After the court hearing the magistrate said that the CSA would have to contact me to decide the best payment method,well guess what nothing,i never heard from them all that time ago until now and they are demanding 653 a month to pay off the arrears,and i only earn 1000 a month.They have no threaatened to revoke my licence and or send me to prison. Please help

I had a creditor send me a letter, I didn't know what it was, so I called them.. They said it is a debt from 1999. the last payment made in 10/2001 for $519.00 .. I don't remember this debt and I told them I dont remember having this credit card from world financial network national bank. So am I still liable since the debt is old? Should I just leave it alone. They wanted me to pay 839.79 or settle for 419.00 today. HELP

Hi

I was looking for a bit advice. I've had a letter from mckenzie in kilmarnock looking to pay back a loan taking out in i think 2000? I have not contacted them as it's in my maiden name and have previously been binning any i get (maybe 2 in my 4 years in this house). I cannot remember time frames exactly but dont think a payment will have been made since 2001? I have certainly had no contact with them admitting to the debt in over 5 years (i hope). I'm afraid to contact them incase my estimation of the dates are wrong but don't think it can be far off. If i'm wrong and I send the statute barred letter will they come after me quick? Do you think I should continue to ignore as long as poss?

SEND the statuet barred letter, were in 2011 now so as long as you are sure, it was before 2005 you will be ok,

out of interest how much is the debt for anyway?

the debt is now for 7995 as I think it must have been a long time before they freezed the interest. Dont know how much it was for in the first place, my ex spent it then done a bunk! I have just read that if you have a ccj then the statued barred would not work. I dont know of a ccj against me but apparently you dont always know about it?? I have also just found out that this mckenzie mob from kilmarnock have had a warning about there conduct before so they are walking a fine line as it is! Maybe this info will be useful to others as i've had 3 letters in three days. Thanks so much for your help as I was getting very worried. Its very much appreciated!!

one thing i do know kellis is, ive personally NEVER been concerned if someone has had a CCJ registered against them in realtion to walking the statuet barred path, i have never found it to be picked up on or used gainst a debtor as a reason to ignore the debt being statuet barred,

its statuet barred deal with it as such if they give u any cheek about it, book an appointment with your local councils trading standards department, and that will end the matter,

or ure other post has the ways to discover if u have a CCJ anyway

I have a similar question I have a number of debts that may have resulted in defaults or CCJS but I would not be aware of this as I have moved several times since 2006 and just recently remarried. I was going through a breakdown of a relationship which divided my family and paying the debts off at the time was very difficult for me.


Can I still be traced for these debts if I start searching credit files in my new married name? We have been asked to do credit checks by a prospected landlord and next year we may want to get a mortgage. We are not on an electors role either as we have only been in rented accomodation for 6 months but the tenancy is coming to an end.

I'm worried that the creditors will be informed by the credit agencies and I will start being chased for debts.

Sober1 - Hi I am having a very similar problem myself. In the last three weeks I have received two letters from collection agencies, one for a debt that is about 8 years old, last contact or payment I made to them must have been about 6/7 years ago and one for an old joint bank account with my ex which I stopped using in 2005. I have no idea why they are writing to me now under my old surname and have not contacted me before. I am not going to respond until I am able to quote anything substantial and think its best to get advice, either from the cab or here as there have been some very good points raised. Let me know how you get on and how you dealt with it.
