Joined: 18 Oct 2008 Posts: 3 | Can someone please help i dont know if im in the right forum for this, i received a letter from s c gray solicitors limited saying commercial credit services has passed this case on to them and instructured them to issue court proceedings for recovery of £112 that i owed to bt when i cancelled with them, they are saying on the 29/10/08 a claim may be issued against me in the appropriate COURT unless payment of the outstanding debt is received, they said id be liable for court fees of £27 and solicitors costs £50 they then went on to say they may employ agents in my area to make inquiries to confirm my residence and apply for a charge on my property and apply for an attachments of my earnings, im actually on income support and receive child tax credit, i dont have alot of money as im a single parent but terrified they will tk me to court, can someone please give me some advice will they carry this through and tk me to court? kindest regards. |

Speak to the debt collectors saying that you are willing to repay the debt, but can't afford to pay it all in one payment. Try and arrange installments based on what you can afford and support this with a break down of your income and expenditure. Joined: 13 Nov 2008 Posts: 2 | Hi, Firstly dont panic!, remember that these people are bullies and want to scare you into paying the whole amount at once. there are a few places that can help you, try the consumer credit councelling service, they arn't what they sound, they will tell you that because you are on benefits that you should only offer the creditor (solicitor or debt collection agency) 1 pound per MONTH only! Dont forget that the benefits system is there to stop you starving and not to give you a disposable income. Write to them (the solicitors) and explain your situation, enclose a cheque or P.O for 1 pound (or more if you can afford it), by sending a payment to them it shows 'good faith'. If they send anyone to your house they have NO right to enter your property, only a court appointed bailiff can enter and these people arn't bailiffs so dont answer the door to them, in fact they can only visit your property whith your permission so if you dont want 'em to come round tell 'em this in your letter. It is standard practice for these wolves to threaten court action as it scares people into paying, stick to your guns, the chances are that when they know your situation they will realise that any court wont award them more than you can afford. Keep us up to date, dont let them bully you. |

Joined: 01 Dec 2008 Posts: 1 | I have also received a letter from S C Grey Solicitors on behalf of CCS/Scottish Power for an amount of £139 for an address that has since been changed to flats by the purchaser of the property. The letter is addressed to C/O Flat 1 of that address. Their letter does not contain any details of the amount they say is owing; meter readings or dates. It simply says pay or else! Upon phoning the contact tel. no. on the letter I received nothing but a stream of rhetorical statements insisting that I had to pay or the matter would be passed to their debt collection dept with additional charges for legal costst for debt recovery. Interestingly they don't offer any legitimate organization that I can respond to, JUST there own debt recovery department !!!! I did pay all the bills up to date on the date of sale but I don't have any of the paperwork; I foolishly threw it away as this was 18 months ago, ... I would have been happy to continue my account with their supply of service but I was informed by their offices that they could not provide a service at my present address so I have changed to another provider who can.... is this just sour grapes ... OR SOMETHING MORE SINISTER ? The credit crunch is effecting all of us, and as I work as a broadcaster i would be happy to hear from anyone else suffering from these 'bullyboy' tactics to balance the books of energy companies who have mismanaged their books whilst announcing record profits at our expense. Businesses are required to prove debts owing to them by law before they take legal proceedings, not just threaten their customers without proof. Hers's the science bit,... metering of every kind requires calibration of the meters on a regular basis to return accurate results. How many times have you seen your meters checked or calibrated to ensure accuracy ? Hmmmm? ....not to mention the leaks from their systems which they continually avoid fixing under legal loopholes. |
