I recieved a letter from Cabot Financial July of 2009. apparentely, they had my debt with them since 2007 and registered me on the credit reference file. At first I ignored their letters as they were only asking me to contact them urgently. As I did not know who they were, I ignored their letters. Eventually, they sent me a letter stating that they will come to my home if I did not contact them. In fear, I telephoned them and found out that it was for a debt they had bought from Capital One card, which I owed just under £700. On the telphone they refused to agree a low payment, even after I told them that I could not pay the money in full. I was on the telephone for nearly 1 hour and I felt like I was being harrassed, in the end to get them off the phone, I agreed to a £50 monthly payment. they wanted my bank details to set up a direct debit, but I refused and managed to get their bank details to set up a standing order. They sent me a letter, stating my agreement to this monthly payment of £50. I have not paid anything as I really cannot afford to pay them. They have sent me a letter stating that if I don't pay them they will either, send round a debt collector, obtain a deduction of earnings, obtain a county court order against me, or gain entery into my home to seize goods. They ring me about 3 - 6 times a week, sometimes on the weekend. I really don't know what to do. Can someone advise, can they do any of these things? I'm not even sure how old my debt is. |

Joined: 06 Jan 2010 Posts: 15 My Profile | Firstly, insist on all paperwork pertaining to the debt. Take it to your local money advice outlet or Citizens Advice Bureau, that way you will not only obtain relevant advice and assistance but they should negotiate with Cabot on your behalf. You will also see a reduction in calls from Cabot and you can simply tell Cabot to phone your representative and put the phone down. In short, each of their threats is valid, although you could contest any court hearing. Regarding continuous phone calls.......keep a diary and submit the detail to the Office of Fair Trading. Such regular phone calls could be deemed as harassment and as such illegal. There are sanctions which can be taken against Cabot which would affect their ability to trade. |

Joined: 30 Dec 2009 Posts: 4 | Hi Mr Smith, Thanks for the advice. I took one of Cabot calls, which tends to be about 4 - 6 per day, and asked them to send me all paperwork relating to my debt. My caller was rude and everytime I said something to him ("I would like to see all paperwork first, before I discuss anything further with you"), he would say "are you disputing the bill"?, or " are you refusing to pay your debt owed to Cabot". I told him that I had been avised by the CAB to ask for these details and once I had recieved them to make an appointment with the CAB for them to discuss with me. The caller would then say " are saying that you've not been in contact with the CAB". "If you have, let me have the CAB reference number" In the end I put the phone down on him. This morning I reciaved a letter from Cabot asking me to fill out a form attached asking for additional information before they can answer my query. The letter states: Dear...... Your query Your account has been referred to our Customer Relations Department and we need some additional information from you before we can answer your query. Contacting Cabot. So that we can deal with this matter for you as quickly as possible, please either: - Call one of our helpful customer advisors on 01732 524615 OR -Tick the relevant option below and return the completed tear off slip to us, together with any relevant documents, in the enclosed prepaid envelope. Thank you Your sincerly Emma Robertson Customer Relations Manager These are the boxes that Cabot have asked me to tick: Details of my query. -The outstanding balance on my account is incorrect -I've paid the outstandin balance on this account -This account is fraudulent -Fraudulemt transactions have been made on this card -Other -please specify below. I'm not sure what to do. I did have a credit card account with Capital One, but I cannot remember how old this account is and I don't want to start paying money to Cabot, then to find out the debt is over, or nearly 6 years old.
