Hi

I haven't been able to pay the minimum payment on my Barclaycard credit card so it's been passed over to Mercers. I have been sending them money by standing order over the past few months but they want more. Because of this they won't freeze the interest so it's putting me further into debt. I'm not sure what to do. I've told them several times I cannot afford anymore. I was wondering whether to stop payments all together to see if they will freeze the interest or to ask for my PPI back. I wasn't told that I could get it cheaper elsewhere and felt obliged to take it out. Can I do this if the account is in dispute?

I would strongly advise, seeking help from your local CAB office. They have been very helpful regarding my debt to Barclaycard.

How much are you in Debt? it may be well worh looking at this site, they offer no debt plans, no long term payment plan. These guys wiped out my Credit Cards within 14 days, and offer a 100% money back guarantee.

With regards to your PPI if you have arrears they will no doubt want to clear these firstly and you have a risk of your lender applying the PPI refund against your debt.

PPI is a contentious subject - Barclaycard would not have told you that it was possible to get insurance cover elsewhere and so they signed you up for your "protection". However, getting the protection you are paying for is another matter. The insurers will take every possible step to avoid paying out - I am assuming that your income has fallen or disappeared. Read the terms of the PPI policy to see if you are covered for loss of employment
Harrassment under the 1970 Criminal Justice Act section 70, quote this if you are being called constantly and tell Mercers to back off or you will report it to the OFT.
The creditors are coming on strong at the moment because of the recession but you have to hold your nerve and promise only to pay them what you can afford. Send copies of your statement of affairs to both Barclaycard and Mercers by registered post. As far as they are concerned, to get even a derisory small amount each month is better than nothing. Take the long view, your circumstances can only improve in time and you will get back in the position to start serious repayments again. For the time being they will have to accept what you can afford - the secret here is to keep paying even a £ 1.00 per month is better than nothing. Of course they won't be happy but there are many people out there who are doing this and hey they were happy when the good times were rolling and you were being charged handsomely for using your card and they greedily increased your credit limit without you having to ask for it I imagine.

Hi Thank you for this. I will send the harassment letter to Mercers and I've also put in a complaint to Barclays for what it's worth. I will try and find my policy and see what it says. Thank you.
