Joined: 22 Jul 2007 Posts: 2 | I checked my equifax last year for the first time ever but this time around I checked the experian one as well as I was applying for a mortgage. I am in total shock now as apparently I owed them £24.96 in febuary 2005 and they have given me a default for it! I never owed them anything and the account was settled and ended and now after no letters or contact I am in a situation where I can't get a mortgage with a decent interest rate because of this one bad mark! I believe now that a lot of people suffered with O2 online I even think it has been on watchdog! Despite calling them earlier I don't think the girl on the other end of the line new what she was talking about. Apparently according to her O2 can give out a default on the account without sending it by post, because it is an online account and should be viewed online. If I thought it was fully paid and closed why would I return to look! Someone tell me that she has it wrong as I thought a default could only be given by post. I have found a website with a few example letters to try and force them into providing a copy of the default but I must have a back-up plan as I have to get this removed in order to move out! I'm 28 now and don't want to be a kipper anymore. I will do whatever it takes so what other options do I have.... 1. Solicator?? 2. Trading Standards?? 3. Offcom?? lol. 4. any other options i do not know??? Please give me some advice so I can get this resolved. Thanks neil. |

Joined: 01 May 2007 Posts: 174 My Profile | Neil You are right you do need to have a written copy of your default notice. Write to O2 and request a copy of the default agreement. Let me know how you get on because there are repercussions for 02 if they cannot prove that they provided you with the required satutory information. post back George |

I certainly don't remember getting one but maybe it was lost in the post? I am just very worried because if I can't get this removed I won't be able to get an affordable interest rate and mortgage till 2011! All that over £25! I would pay £500 to a solicator if it would certainly get it removed. |

Joined: 01 May 2007 Posts: 174 My Profile | Neil I am certain that email is not a recognised method to informing you of your default. If they can't prove that they provided you with the default notice then you can demand that the default notice be removed from your credit file. You may be able to recover from 02 any financial loss incurred from the false information held on your file. George |

A couple of point, no mortage company should ramp the interest rate for such a small default and it being a tele comms company, second O2 would have to write to you every month for at least six months to tell you that no payment was made. To be honest the best way to get this cleared up is find the email for the CEO CFO most of the time you can get it on there website and send them a couple of emails you will find it will be sorted in a couple days tell them you will go to every news paper that you can. |
