Joined: 23 Jan 2012 Posts: 2 | I am pleased to say that husband and I finished our IVA in August 2011 having paid excess money etc and just waiting for our final certificate any day. Anyway, that aside, after receiving numerous phone calls over the years and ignoring them, my husband suddenly thought that may be we could claim some PPI monies from a car loan with Yes Car Credit taken out in 2003 and finished in 2008. I believe you can still pursue a claim if the agreement finished within the last six years as loan companies keep paperwork for six years after the agreement has finished. If the loan was with a high street bank or something it wouldn't be a problem but the problem we have is that I don't think we still have a copy of the agreement and Yes Car Credit went out of business under a cloud I believe. Thinking back, we took this loan out before we started our IVA but were struggling with debts at the time which is why we chose them and from memory, we had a very small basic car paying £158 a month over five years and I am sure we had pp insurance on it. In the past when we were both working fulltime and taking out loans for home repairs etc, we were never ever persuaded to take out loan insurance; we stuck to our guns as we were in secure jobs. However when this car loan was taken out we were starting to struggle with our debts and could not get credit with the banks as we were all "credited out" but desperate for a family car (a necessity living semi-rural with small children) and I can vaguely remember just agreeing and signing up to insurance etc, as we felt we had no choice. We have received some papers from a PPI company and now the IVA is finished and we have seen the light about this car loan and we are going to pursue a claim. Our problem is the fact that Yes Car Credit are now out of business and we don't have a copy of the loan agreement to hand. Is there an agency that files loan agreements and given the name of the company, the date (more or less) and our full names and addresses, would this agreement be capable of being located. It would be nice to have a little windfall post-IVA as we are starting from scratch with nothing, as most of us post IVAers do I suppose. I am wondering if the IVA company have a copy as though this agreement wasn't part of the IVA, we were due to pay more money into the IVA once this agreement had finished. I don't want to ask them if I don't need to though. |

Joined: 23 Jan 2012 Posts: 2 | Re-reading my longwinded post particularly at the end (sorry it's a pain!) there isn't a problem as such phoning the IVA company to see if they have a copy of the car loan agreement, that was all dealt with as intended and they received the extra monies. I am just reluctant to phone them because we are annoyed at the length of time it is taking for us to receive our completion certificate and keep getting fobbed off and patronized so have written to them threatening to lodge a formal complaint soon so doubt they will pull out all the stops for us on this! |
